Abstract

Based on the provisions of Article 1 of Law Number 1 of 1974 concerning marriage, it is stated that marriage is a spiritual and physical bond between a man and a woman as husband and wife to form a happy and eternal (household) based on the belief in the Almighty God. Marriage is an important thing in human life. The decision to live together must be based on the laws in force in Indonesia. However, it is not uncommon for us to face various life problems amid our domestic life which can lead to divorce, etc. One cause is the difficult economic situation. This is a strong reason for conflict in husband and wife relationships and ends in divorce. Based on Article 114 of the Compilation of Islamic Law, the severance of marital ties due to divorce can be caused by a divorce from the husband or a lawsuit from the wife. Divorce is permitted on the basis that the benefits outweigh the negative aspects.
